Masharti ya Matumizi

Masharti haya yanahusu matumizi ya BIASHARA ENTERPRISE SOLUTION ("huduma"), mfumo wa kusimamia biashara unaotolewa na BIASHARA ENTERPRISE SOLUTION ("sisi"). Kwa kufungua akaunti au kutumia huduma, unakubali masharti haya.

1. Akaunti yako

• Lazima uwe na umri wa miaka 18 au zaidi na uwe na mamlaka ya kufanya maamuzi kwa niaba ya biashara unayoisajili.
• Toa taarifa sahihi na uzihifadhi zikiwa sahihi.
• Linda nenosiri lako. Tunashauri kuwasha uthibitisho wa hatua mbili (2FA).
• Mmiliki wa biashara anawajibika kwa watu anaowaalika na kwa vyeo na ruhusa anazowapa.

2. Majaribio, mipango na malipo

• Kila biashara mpya inapata siku 14 za majaribio bure.
• Baada ya majaribio, huduma inalipiwa kabla kwa mwezi au mwaka, kwa bei zilizo kwenye ukurasa wa Bei. Malipo yanafanyika kupitia Selcom.
• Muda wa mpango ukiisha bila kulipia, biashara inabaki ikiweza kusomwa tu: data yako haifutwi, lakini huwezi kuongeza au kubadilisha kitu hadi ulipe.
• Malipo yaliyokwisha fanyika hayarudishwi kwa sehemu ya muda usiotumika, isipokuwa pale sheria inapotaka hivyo au tulipokosea sisi.
• Tukibadilisha bei, tutakujulisha angalau siku 30 kabla. Bei mpya inaanza kwenye malipo yanayofuata.

3. Data ya biashara yako

• Data unayoingiza (bidhaa, mauzo, wateja, wafanyakazi na mengineyo) ni mali yako. Tunaitumia kukupa huduma tu.
• Unawajibika kuhakikisha una haki ya kuweka taarifa za wateja na wafanyakazi wako kwenye mfumo.
• Unaweza kupakua ripoti zako (Excel/CSV au PDF) wakati wowote.

4. Kodi na risiti

• Risiti za mfumo si risiti za kodi za TRA (EFD/VFD). Endelea kutumia mashine yako ya EFD au VFD kwa risiti za kodi.
• Hesabu za kodi kwenye mfumo ni makadirio ya kukusaidia. Si ushauri wa kodi. Wewe ndiye unawajibika kwa kodi zako na mawasiliano na TRA.

5. Matumizi yasiyoruhusiwa

Usitumie huduma kwa jambo lolote lililo kinyume cha sheria, kwa udanganyifu, kujaribu kuingia kwenye akaunti zisizo zako, kuvuruga mfumo, au kunakili na kuuza huduma bila ruhusa yetu.

6. Upatikanaji wa huduma

Tunajitahidi huduma ipatikane wakati wote, lakini kunaweza kuwa na matengenezo au hitilafu. Tunahifadhi nakala za data (backups) mara kwa mara.

7. Ukomo wa dhima

Kwa kiwango kinachoruhusiwa na sheria, hatuwajibiki kwa hasara isiyo ya moja kwa moja, kama faida iliyopotea. Dhima yetu yote haizidi kiasi ulichotulipa katika miezi mitatu iliyopita.

8. Kusitisha

• Unaweza kuacha kutumia huduma wakati wowote.
• Tunaweza kusimamisha akaunti inayokiuka masharti haya, na tutakueleza sababu.
• Ukiomba kufutwa kwa akaunti, tutafuta data yako ndani ya siku 90, isipokuwa ile ambayo sheria inatutaka tuitunze.

9. Mabadiliko na sheria

Tunaweza kubadilisha masharti haya. Tukifanya mabadiliko makubwa tutakujulisha kabla hayajaanza kutumika. Masharti haya yanaongozwa na sheria za Jamhuri ya Muungano wa Tanzania.

These terms cover the use of BIASHARA ENTERPRISE SOLUTION (the "service"), a business management system provided by BIASHARA ENTERPRISE SOLUTION ("we"). By creating an account or using the service, you accept these terms.

1. Your account

• You must be 18 or older and have authority to act for the business you register.
• Give accurate information and keep it up to date.
• Keep your password safe. We recommend turning on two-factor authentication (2FA).
• The business owner is responsible for the people they invite and the roles and permissions they give them.

2. Trial, plans and payment

• Every new business gets a free trial of 14 days.
• After the trial, the service is paid in advance, monthly or yearly, at the prices on the Pricing page. Payments are made through Selcom.
• If a plan ends without being renewed, the business becomes read only: your data is not deleted, but nothing can be added or changed until you pay.
• Payments already made are not refunded for unused time, except where the law requires it or the mistake was ours.
• If we change prices, we will tell you at least 30 days before. New prices apply from your next payment.

3. Your business data

• The data you enter (products, sales, customers, staff and more) belongs to you. We use it only to provide the service.
• You are responsible for having the right to put your customers' and staff's information into the system.
• You can download your reports (Excel/CSV or PDF) at any time.

4. Taxes and receipts

• Receipts from the system are not TRA fiscal receipts (EFD/VFD). Keep using your EFD or VFD for fiscal receipts.
• Tax figures in the system are estimates to help you. They are not tax advice. You remain responsible for your taxes and dealings with TRA.

5. Not allowed

Do not use the service for anything unlawful, for fraud, to try to get into accounts that are not yours, to disrupt the system, or to copy and resell the service without our permission.

6. Availability

We work to keep the service available at all times, but there may be maintenance or faults. We back up data regularly.

7. Limit of liability

As far as the law allows, we are not liable for indirect losses such as lost profit. Our total liability is limited to what you paid us in the last three months.

8. Ending

• You may stop using the service at any time.
• We may suspend an account that breaks these terms, and we will tell you why.
• If you ask for your account to be deleted, we delete your data within 90 days, except what the law requires us to keep.

9. Changes and law

We may change these terms. For major changes we will tell you before they take effect. These terms are governed by the laws of the United Republic of Tanzania.
